Information for Consumers on Distance Selling Contracts and on Contracts in Electronic based business relations
§ 1 Area of Application
All business relations for orders placed via the Internetshop are based on these Terms and Conditions as valid on the date of order.
§ 2 Conclusion of contract
The presentation of our products on our website solely represents a request to the customer to place a contract offer.
As the customer places an order, he makes an offer per § 145 BGB. The customer receives a confirmation of receipt of the order via E-mail. As the case may be, we will separately inform the customer about possible mistakes regarding the product line displayed on our Website and make an offer for an alternative product.
The customer waives the receipt of a letter of acceptance, § 151 S.1 BGB. The contract is concluded if we accept the customers offer in writing or via E-mail within 10 days or if we send the merchandise or if the customer pays in advance if payment is received 10 days after placing the order.
§ 3 Bearing of regular cost on return shipments in case of order revoke
The cost of return shipments are the buyers responsibility if the delivered merchandise complies with the merchandise that was ordered and if the price of the returned merchandise does not exceed Euro 40.00 or if, on merchandise with a higher price, no payment or partial payment has been made to the moment of the order revoke. Elsewise the return shipment is free of charge for you.
§ 4 Delivery, Shipping Charges, Transfer of risk
The delivery takes place at the shipping costs respectively disclosed in the order process. If the customer is consumer we carry the risk of loss or damage regardless of the shipping or payment method. If the customer is entrepreneur, all risks for loss or damage devolve to the customer at the moment the shipment is turned over to the assigned Logistic Partner.
§ 5 Retention of Title
Delivered merchandise remains our property until the purchase price has been paid in full.
§ 6 Payment
We only accept the payment options offered to the customer during the order process.
§ 7 Warranty
Implied Warranty is granted according to the German Civil
Code (BGB). In case the sale is a commercial deal for both parties German
Commercial Code rules are unaffected.
Due to the nature of the Product there is no warranty on Wood Bats.
§ 8 Information for Consumers on Distance Selling Contracts and on Contracts in Electronic based business relations
a) We are not subject to any unmentioned special Codes of
conduct.
b) Input errors during the order process can be recognized and corrected with
the „delete“ and „change“-functions in the order summary at any time before submitting
the order.
c) Please find the description of the essential attributes of the products that we
offer as well as the validity period of limited time offers with the product
description of the item on our Website.
d) Available languages for contract conclusion are German and English
e) Please direct any claims or Warranty claims to the address listed in the „About
us“ section.
f) You can save the wording of this contract to your computer by right clicking
your mouse in your browser or print it out by using your browsers “print”
function. The wording of this contract is not available for customers when
ordering via our Webshop.

g) Please find all informationen regarding payment, delivery or performance of
contract in Webshop.
h) During the order process in our Webshop you will be informed about
possibilities to detect and correct type errors.
§ 9 Miscellaneous
a)
The contract between the customer and us as well as the particular Terms and Conditions shall be governed by German law. If the customer is consumer any existing consumer protection laws in the customer’s country of residence remain unaffected from this agreement.
The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.
b)
Sole legal venue shall be the court of our business location if the customer is
businessman in terms of the German Commercial Law (HGB) or if the customer is
acting as part of a public cooperation. We have the right to file suite at the
customer’s residential court also.
§ 10 Severability Clause
The invalidity, in whole or in part, of any of the provision of these Terms and Conditions, shall not affect the enforceability of any of the other provisions thereof.
